CONSERVATION COMMISSION

MEETING DATE: January 12, 2009
Present: Richard Andrus, David Dempsey and Christopher Blair
The meeting convened at 6:05p.m.
Lang – 19 Point Rd. – RDA – pour footings to support a 6’x 50’ cantilevered balcony (R. Andrus is the project manager)
Enrico Hinz, representative for the Lang’s was present to review the project. The Commission approved the project as a N3 with the special condition that the silt fence as shown on plan. The Commission questioned whether or not the cantilever changed the footprint (this would be an issue with the Building Department if it is an issue). The Commission can approve the project under their jurisdiction. The Commission noted that the deck can not be enclosed.
Leffler – Steven’s Lake Way – RDA – to cut and remove small trees to obtain a view (C. Blair is the project manager)
Paul Hess, representative for the Leffler’s was present to review the project. The Commission approved it as a N3 with a special condition that no cutting be done within 80’ and discretionary cutting after that. When the owners submit their proposal to build a house to the Building Department, the Commission will review this further.
Erlich – 26 Northwest Cove Rd RDA to seasonally install and maintain two docks, one floating and one suspended plus a canopy which will all be removed in the winter months (enforcement order sent previously) (D. Dempsey is the project manager)
This hearing was continued as the applicants are in negotiations with the state as we understand it.
Schwartz – 66 Art School Rd – NOI 230-0249 continue the pond program maintenance to prevent the establishment of invasive species and to preserve desirable water quality (T. Lovett is the project manager)
A certificate of compliance was also requested for a previous project. Chris spoke with the representatives about the request for the certificate of compliance for the previous pond maintenance work (D. Dempsey was the project manager). The Commission reviewed the request and approved it for DEP file #230-205. The Commission reviewed all the comments submitted on the NOI. This project was approved with additional special conditions.
For Discussion:
1. Mail was reviewed.
2. The ZBA special permit application for 20 Point Rd was reviewed. The Commission approved this RDA back in October of 2008 to add a 12'x14' 2nd story, one new pier required.
